Lex Bangkok recently attended the continuing legal education seminar “Sexual Harassment Law Amendment” organised by the Lawyers Council of Thailand Under the Royal Patronage. The seminar focused on Thailand’s latest legal reforms on sexual harassment, and how these reforms interact with existing criminal and labour law. It was a very insightful and practical session, giving us updated perspectives from both academic experts and practitioners who work with these issues on a daily basis.
The speakers explained how Thai law now defines “sexual harassment” in a clearer and broader way, covering unwanted conduct of a sexual nature in many forms, from physical contact and verbal comments to online behaviour. A key part of the discussion was the amendment to Criminal Code section 397, as well as the relationship with more serious offences under section 278 of the Criminal Code, especially where force, threats or abuse of a vulnerable situation are involved. On the labour side, the seminar revisited employers’ duties to prevent sexual harassment in the workplace, including the need for internal policies, complaint mechanisms and training that protect all employees regardless of gender or sexual orientation.
